Welcome to Kawan! These Terms and Conditions (“Terms”) govern your use of the Kawan platform, website, and related features (“Services”). By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services. Our Privacy Policy forms part of these Terms.

2. Eligibility

Kawan is strictly for individuals 18 years or older. By using the Services, you confirm that you meet this requirement.

3. Nature of the Services

Kawan provides a social platform that helps users discover events and connect with others (“buddies”). Kawan:

• Does not organize or supervise user meetups
• Does not act as a party to interactions or agreements between users
• Provides an optional identity verification feature through a trusted third-party provider (KYCaid)

This verification feature is intended to enhance trust among users. However:

• Verification is not mandatory
• Verification relies on information submitted by the user
• We do not guarantee that a verified user's identity, intentions, behavior, or background are accurate, genuine, or risk-free

You remain solely responsible for your interactions with others, whether online or offline, and attend any event at your own risk. Kawan is not responsible or liable for any loss, damage, injury, incident, misconduct, or other negative outcome that may result from meeting or interacting with other users.

4. User Responsibilities & Safety

• You are solely responsible for your personal safety and decisions
• Kawan does not conduct background checks on users
• A “Verified” badge does not ensure that a user is trustworthy or safe

5. Definition of “Verified”

A “Verified” badge means the user has completed an optional identity verification with KYCaid. It does not confirm trustworthiness, safety, compatibility, or compliance with these Terms.

6. Code of Conduct

You agree not to use Kawan to:

• Harass, abuse, threaten, or discriminate against others.
• Spread false, offensive, or harmful content.
• Promote illegal activities, violence, or hate speech.
• Engage in fraud, scam, spam, phishing, or manipulation.
• Misuse the platform in any way.

Kawan may suspend or permanently ban users who violate these rules.

7. Impersonation & Misrepresentation

You must provide accurate and truthful information, including age and gender. You may not:

• Pretend to be someone else
• Create fake accounts
• Misrepresent your identity or intentions

Violations may result in immediate termination.

8. Your Account

• Keep your login details secure
• You are responsible for all activity under your account
• Do not share your account with others

9. Intellectual Property

All rights in the Kawan platform, designs, branding, and technology belong to Kawan. You may not copy, modify, reverse engineer, or commercially exploit any part of the Services.

10. Payments & Refunds

• All purchases (tokens, subscriptions, etc.) are final and non-refundable, unless required by law
• Payment terms may change with notice
• You must ensure your payment information is accurate

You may request access, correction, or deletion of your personal data at any time.

12. Reporting & Moderation (DSA Compliance)

We may remove content, restrict access, or terminate accounts as needed to comply with these Terms and the law.

You may block abusive users in the app. Blocking may remove you from shared chats or buddy groups with that user, and reports or blocks may be reviewed by Kawan for safety and moderation purposes.

Abusive behavior, harassment, scams, or other violations may lead to content removal, suspension, or a permanent ban.

13. Modifying or Terminating Services

We may modify, suspend, or discontinue the Services at any time without liability for any resulting losses.

14. Disclaimers

We provide the Services “as is” and “as available”. We do not guarantee:

• Continuous or error-free operation
• The accuracy of event information
• Successful or satisfactory buddy matches

15. Limitation of Liability

To the maximum extent permitted by law:

• Kawan is not liable for indirect, incidental, special, or consequential damages
• Kawan's total liability is limited to the amount you paid us during the previous 12 months (if any)

This applies regardless of legal theory (including negligence).

16. Indemnification

You agree to indemnify and hold harmless Kawan, its founders, employees, and partners from any claims, losses, or damages arising from:

• Your use of the Services
• Your interactions with other users
• Your breach of these Terms

17. Governing Law & Disputes

These Terms are governed by the laws of the Netherlands. Disputes must be brought exclusively before the courts of Rotterdam, the Netherlands.

18. Changes to These Terms

We may update these Terms at any time. The revised version will always be available on this page. Continued use means you accept the changes.

19. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

20. Entire Agreement

These Terms form the entire agreement between you and Kawan regarding use of the Services.
